The Regional Magistrates’ Courts deal with more serious cases than the ordinary Magistrates’ Courts - for example, murder, rape, armed robbery and serious assault. In terms of the Criminal Law (Sentencing) Amendment Act (No 38 of 2007) a Regional Magistrates’ Court can sentence a person who has been found guilty of offences that include murder or rape to imprisonment for life.

They are the courts of first instance for most criminal cases except for the most serious crimes, and for civil cases where the value of the claim is below a fixed monetary limit. Every magistrate's court is vested with original criminal jurisdiction (other than in respect of offences upon indictment in the High Court), and is ordinarily empowered to impose sentences up to a fine of Rs. 1,500 and/or 2 years rigorous/simple imprisonment unless power is vested in the Magistrate's Court to impose higher penalties by special provision. A Magistrates' Court can try offences where the maximum imprisonment term does not exceed 5 years or which are punishable with a fine only.
